3. NRS 281.501: Failure of consistency in the language about seeking gifts::

Rationale:

NRS  281.481 says, AA public officer shall not seek or accept....@ [emphasis added], but then at 281.501, this time discussing conflicts of interest, it now says, at section 2, (a), Ahis acceptance of a gift....@. First, neither seek nor accept; then, only acceptance is a problem. This inconsistency was probably due to an oversight.  Or it might have been due to an effort to allow the seeking of gifts when conflicts of interest are being defined, only punish the accepting. But in either case, the time is ripe to strengthen 281.481 by keeping the language prohibiting the seeking or accepting of gifts at .481, AND to follow this consistently so that under .501,  seeking is covered, along with accepting.

BDR:

Edit so as to retain the meaning of .481 and build on it in .501, by keeping the wording of .481 but then revising .501 to read, at section 2 (a), A...his seeking or acceptance of a gift.....
