NRS 281.501 (1). Re-introduce the part of 2005's AB 530 as to what comes after abstaining. This means replacing the state permission to keep Aparticipating@ with the Clark County standard that one removes oneself from the discussion entirely. [281.501.7]
Rationale:
Current law allows the person to disclose, abstain, but continue to Aparticipate@ on a given issue. No clear line is drawn between advocating and >participating=, and none can be drawn. When one has abstains, one should remove oneself from the deliberative process on that issue. Clark County has already established this rule.
BDR: Amend NRS 281.501. 7 as follows [edited since 2005 version]:
39 7. If a public officer or employee decides that a
40 commitment in a private capacity to the interests of others exists
41 with respect to a matter, the public officer or employee shall:
42 (a) Make a disclosure regarding the commitment that complies
43 with the requirements of subsection 4; and
44 (b) Abstain from voting on and refrain from advocating the
45 passage or failure of or otherwise participating in the
1 consideration of the matter if the independence of judgment of a
2 reasonable person in his situation would be materially affected by
3 the commitment.
