(2) . Close the loophole in NRS 281.481.1 :
Rationale: The statute currently reads that a public officer A...shall not accept any gift...which would tend improperly to influence a reasonable person in his position....@ Why include improperly? Is there a way properly t o influence a public officer by giving a gift? We think there is no way properly to try to influence a public official by way of gift-giving. Use of the word is not only unnecessary, but also bad policy because it opens a loophole to disputes and degrees of what counts as >proper=. This loophole has been used as such by lawyers defending complainees who are seen by citizens who complain about those seen as improperly taking gifts.
